Terms of Service

These Terms of Service ("Terms") govern the use of web development services provided through maksimovicdanijel.com (the "Site"). By subscribing to a plan or engaging me for a fixed-price project, you agree to these Terms.

01Services

I provide web development services focused on Webflow, Xano, JavaScript, and automation tools such as Make and Zapier. Services are offered in two forms:

• Monthly subscription ("Monthly On-Call Club") — a flat monthly fee with an unlimited number of development requests, delivered one at a time through a shared Trello board.
• Fixed-price projects — one-off engagements with a scope and price agreed in writing (email is sufficient) before work begins.

Requests outside the supported stack — such as standalone Figma design work or fully custom-coded development outside the no-code stack — are not included and may be declined.

02Subscription & Billing

• The subscription is billed monthly in advance via Stripe, starting on the date of purchase.
• Payment is processed by Stripe; I do not store your card details.
• You may submit an unlimited number of requests. Requests are queued and delivered sequentially; larger requests are broken down and delivered in increments.
• Stated delivery times (e.g. average first-task delivery) are good-faith estimates, not guarantees. Complex tasks may take longer.
• You can cancel at any time via the Stripe customer portal or by email. Cancellation stops future renewals; the current billing period remains active until its end.
• Prices may change with notice. Changes never apply retroactively to an already-paid billing period.

03Client Responsibilities

• You provide timely access to the accounts, assets, and content needed to complete requests (e.g. Webflow project access, copy, images).
• You confirm that materials you supply do not infringe third-party rights, and you are responsible for the legality of the content published on your own website.
• Feedback and approvals given through Trello or email are considered binding for the relevant task.

04Revisions

Delivered work can be revised until you are satisfied, within the scope of the original request. A change of direction that materially alters the scope is treated as a new request.

05Intellectual Property

Upon payment, you own the deliverables produced specifically for you (site structures, page builds, custom code written for your project). I retain the right to use generic techniques, know-how, and non-confidential components developed in the course of the work, and to reference completed projects in my portfolio unless we agree otherwise in writing.

06Confidentiality

Any non-public business information you share with me in the course of the engagement is kept confidential and used only to deliver the services.

07Limitation of Liability

Services are provided with professional care and skill. To the maximum extent permitted by law, my total liability arising from the services is limited to the amount you paid in the one (1) month preceding the event giving rise to the claim. I am not liable for indirect or consequential damages, loss of profit, or issues caused by third-party platforms (Webflow, Xano, Stripe, Make, Zapier, etc.) outside my control. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer rights.

08Termination

Either party may end the engagement at any time. On termination, you remain responsible for payment of the current billing period or work already performed on a fixed-price project, and I will hand over all completed deliverables.

09Governing Law

These Terms are governed by the laws of Poland. Any disputes will first be attempted to be resolved amicably; failing that, they fall under the jurisdiction of the competent court for the service provider's registered seat, unless mandatory consumer law provides otherwise.

Refund & Cancellation Policy

01First-Week Guarantee

The guarantee applies once, to your first month as a new subscriber. Refunds are issued to the original payment method via Stripe, typically within 5–10 business days depending on your bank.

02After the First Week

• Subscription fees for a started billing period are non-refundable after the 7-day guarantee window, since capacity is reserved and work is delivered continuously.
• You can cancel anytime — no notice period, no cancellation fee. Your access and task queue remain active until the end of the paid period, and no further charges are made.
• You're free to re-subscribe later whenever you have new tasks.

03Fixed-Price Projects

For fixed-price engagements, refund terms follow the written agreement for that project. If a project is cancelled mid-way, completed work is billed proportionally and any remaining prepaid balance is refunded.

04How to Request a Refund

Email hello@maksimovicdanijel.com from the address used at checkout, with the subject "Refund request". I'll confirm within 2 business days.

05Statutory Rights

This policy does not limit any rights you may have under applicable consumer protection law, including EU consumer rights where they apply.
